Terms & Conditions

We strongly encourage you to read these booking terms and conditions thoroughly and carefully before booking a tour with us. These terms and conditions contain important provisions regarding the tour you are purchasing including, but not limited to, our rights to alter the tour, our cancellation and refund policies, a limitation of our liability and other important disclaimers, and a requirement that you agree to execute a release of our liability and assume the risks involved with your tour.

The addressee of this notice will be the only recipient of this booking receipt and terms and conditions. It is the sole responsibility of the addressee to inform all other parties traveling of the contents of these terms and conditions. The booking passenger, by accepting this receipt and making payment to TropiQ Trips, acknowledges that they have been advised of, reviewed, and hereby accept these terms and conditions and contract for travel related services.

Contract with TropiQ Trips

This Booking Terms and Conditions Agreement (the “Terms”) is a legal and binding contract between the customer (the “Customer” or “you”) and TropiQ Trips, LLC. doing business as TropiQ Trips (“TropiQ Trips” “we,” or “our”).

This contract applies to any and all bookings, reservations, or similar transactions made TropiQ Trips. These Terms & Conditions apply to each and every person who is part of a Reservation made with TropiQ Trips – whether made directly or through a representative or agent. These Terms include limitation of our liability and other important disclaimers. The Terms also include your rights. It is your responsibility to read this contract entirely and acknowledge that you understand it before making your Reservation and thereby agree to the terms in this contract. By making a Reservation you acknowledge that you have read this contract and agree to its terms.

TropiQ Trips offers you a proven service of arranging tours with vetted, quality suppliers. TropiQ Trips does not own or operate any entity that provides goods or services for your tour including, for example and without limitation, lodging facilities, bus, plane, train, kayaks, yachts or other transportation companies or devices, food service providers, equipment suppliers, etc. Therefore, the services arranged by TropiQ Trips are provided by third party suppliers. Separate “terms and conditions” dictated by the applicable supplier likely apply to your Reservation and purchase and, when that is the case, you agree to abide by such terms and conditions. TropiQ Trips will make those available to you if you ask us for them and when possible. These Booking Terms and Conditions govern our services and your responsibilities at all times.

Definitions

(A)   Terms means these Terms & Conditions.
(B)   TropiQ Trips, we and our, include TropiQ Trips’ owner, employees, representatives, agents and affiliates.
(C)   Customer and you means the person or people who make a Reservation with TropiQ Trips, and also includes the person who is or people who will be traveling on the tour.
(D)   Trip and tour mean the tour or vacation whose components, inclusions, and exclusions are spelled out in each itinerary, including as those components, inclusions and exclusions that may be altered per these Terms. Trip and tour are used interchangeably in these Terms.
(E)   Reservation means a booking that satisfies the requirements stated below for reserving a space on a tour.
(F)    Trip Cost means the amount you must pay for your complete tour itinerary booked with TropiQ Trips.
(G)  Tour Start Date is the first date on the itinerary that you have reserved with TropiQ Trips. It does not include any earlier departure date that you may have planned including, but not limited, to airline flights arranged for and necessary to your embarkation on the Tour Start Date.
(H)   Force Majeure means any circumstances beyond the reasonable control of TropiQ Trips including, without limitation, acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labour strikes, strikes by the indigenous people, requisition, sickness, quarantine, government intervention, weather conditions, and unforeseen circumstances.

Booking Accuracy/Legal Names

Each passenger is required to immediately review all aspects of their booking to verify (but not limited to): passenger names, mailing address, email address, telephone number, date of birth, pricing, airfare, arrival/departure airports, accommodations, and organized activities on your booking receipt. Please notify TropiQ Trips immediately if any omissions and/or corrections are needed regarding the booking details. Passenger(s) voluntarily assumes full & sole responsibility for any and all risks and/or costs involved with failure to report such errors and/or omissions. Passenger is required to verify the accuracy of the passenger’s LEGAL first & last names. It is mandatory that guest names be identical to the Passenger(s) LEGAL first and last names and identical to the names as they appear on passports, booking and travel documents.

Travel Documents

Passenger(s) assumes sole responsibility to independently confirm all documentation requirements for all passport, visa, vaccination, or other entry and/or travel requirements of each destination. Passenger(s) assumes sole responsibility for, and hereby releases TropiQ Trips from any claims or responsibility for any and all damages incurred as a result of Passenger(s) failure to comply with applicable documentation requirements, including but not limited the requirement that all Passengers procure, and have on their person the proper travel documents at all times. TropiQ Trips recommends the Passenger(s) consult with the appropriate domestic and foreign governmental agencies for the current document requirements.

Pricing:

Prices and availability quoted by TropiQ Trips are not guaranteed until deposit is fully paid. Pricing and availability may change without notice. Passenger agrees that TropiQ Trips is not responsible for any errors or omissions in any quotes, advertisements, including on our website, resulting in inventory, content, or pricing discrepancies nor is TropiQ Trips responsible for any errors or omissions that may occur as a result of incorrect information from third parties. Suppliers reserve the right not to honour any published prices that it determines were erroneous due to electronic, printing, or clerical error. You acknowledge this right and agree to hold TropiQ Trips harmless for any actions or damages arising from Supplier pricing. TropiQ Trips reserves the right to charge Passenger(s) for any increase in taxes, fees or surcharges (i.e. fuel). Passenger(s) acknowledge this right and agree to pay any such additional taxes, fees, and surcharge.

Airfare

General Conditions Governing Air Transport
Airline tickets are highly restrictive, non-refundable, and non-transferable. Modification of passenger names, dates, times, routings, or departure/arrival airports is at the sole discretion of the airline and, if permitted, will likely be subject to a substantial change fee.  Passenger is responsible for any such fees.  With regard to the purchase of air tickets, TropiQ Trips acts simply as an intermediary between you and the airline.  Once you book a reservation, your credit card or debit card will be charged for the amount shown – regardless of whether or not the reservation is used. Credit will not be given for any unused airline tickets and cannot be used toward any future bookings.
All tickets will be issued for economy class unless otherwise specified.  All travel will be round-trip unless otherwise specified.  Seat assignments are subject to the airlines policies and may not be able to be made until you are at the airport on the day of departure.  Airline tickets booked through TropiQ Trips may not eligible to earn frequent flyer miles. You agree to confirm all bookings via the online check-in of your airline which usually opens 24 hrs before the flight departure and to confirm your flight arrangements.
Direct flights may be “non-stop” or may involve one or more stop-overs (in the latter case this means the same flight by the airline, because the flight number remains the same).  The same applies to connecting flights that may be subject to crew changes.  When you reserve a scheduled or charter flight involving a stop-over in a town, and the second flight takes off from a different airport to the airport of arrival, ensure that you have sufficient time for reaching the second airport.  The journey to the other airport is at your own expense.  TropiQ Trips will not be able to reimburse you for these costs, nor will it be liable if you miss the second flight.
TropiQ Trips’ responsibilities in respect to air travel are limited by the relevant airline’s conditions of carriage.  The airline fulfilling your contract for carriage may change from the airline mentioned by TropiQ Trips.  TropiQ Trips is not able to specify the type of aircraft to be used by any airline.  If an airline cancels or delays a flight, you must work directly with the airline to ensure you arrive at your destination on or ahead of time. TropiQ Trips will not provide any refund for Trips missed, in part or full.

Luggage

Each airline has its own policy regarding luggage.  We recommend that you check with your airline ahead of time for any weight restrictions and additional charges relating to checked baggage. You will be responsible for paying to the airline any additional charges for checked or overweight baggage, including, but not limited to, golf bags and oversized luggage.  If you exceed the weight limit set by your airline, and excess weight is permitted, you must pay a supplement directly to the airline at the airport.
The airline is liable to you for the baggage you entrust to it only for the compensation contemplated in the international conventions and relevant statutes.  In the event of damage, late forwarding, theft or loss of luggage, you should contact your airline and declare the damage, absence or loss of your personal effects before leaving the airport, and then submit a declaration, attaching the originals of the following documents: the travel ticket, the baggage check-in slip, and the declaration.  TropiQ Trips strongly recommends that you obtain an insurance policy covering the value of your items.

Limitation of Liability for Air Transport
In addition to the limitations of liability set forth above, you agree that TropiQ Trips is not liable for any damages arising from or related to any airline timetable changes, delays, cancellations, missed connections, mechanical problems, inclement weather, seating reassignments, lost/delayed baggage, screening and security delays, refused boarding or failure to check-in properly.

Reservations

To reserve a space on any trip, each Customer must submit:
1. A completed application form, which includes the Customer’s acknowledgment of these Terms,
2. A deposit of 25% of the total tour cost,
The balance of the Trip Cost (the “Balance”) is due at least 60 days prior to departure or as stated in the trip proposal. Failure to timely pay the Balance will result in a Cancellation by the Customer that is subject to the cancellation provisions stated in these Terms.
3. Certain trips, including but not limited to Galapagos, Amazon and Antarctica cruises may require different deposits and final payment schedule.  Please refer to your trip proposal for your deposit amounts and final payment due date.

Accommodations & activities

“Accommodations” are defined as lodgings in a dwelling or similar living quarters afforded to travellers including, but not limited to, hotels, condos, quarters in cruise ships, motels, time shares, camp grounds, and resorts.

a. Accommodation classifications
The number of stars attributed to the hotels and other providers of accommodations quoted by TropiQ Trips correspond to a classification established as a point of reference in accordance with local standards in the host country. Please be advised that accommodations and the “star” designations may vary from country to country.  The comments we make in our descriptions are based on our knowledge of the establishments and the comments we have received from customers. TropiQ Trips makes no guarantee about the suitability or availability of accommodations, and if the particular accommodations sought are unavailable, we will do our best to reserve comparable accommodations, if possible.  You would bear any additional costs, i.e. upgrades, etc.  We reserve the right, for technical reasons, in cases of force majeure or actions by third parties, to replace the planned hotel with accommodation of the same category offering equivalent services.  This would only be in exceptional circumstances and in such case we will inform you as soon as we are aware of this necessity.

b. Taking possession of and vacating your room
Policies regarding taking possession of and vacating rooms often vary by hotel and/or country, so it is your responsibility to check with the hotel ahead of time to verify the relevant policies and times.  TropiQ Trips is not responsible for any charges and damages resulting from your failure to timely take possession or vacate your room.

c. Types of room
Room classifications and amenities may vary by hotel and/or country, so it is your responsibility to check with the hotel ahead of time to verify the specific amenities offered at the time of your stay. TropiQ Trips makes no guarantee that its descriptions and photographs are an exact representation of the particular rooms offered.

d. Meals
These depend on the meal plan chosen / applicable.
• All-inclusive.  This includes accommodation, breakfast, lunch, dinner and normal drinks (mineral water, fruit juice, sodas, wines, local alcohol). Some alcoholic drinks may not be included and will be billed separately.
• Full board.  This includes accommodation, breakfast, lunch and dinner, but no drinks.
• Half board.  This includes accommodation, breakfast and either dinner or lunch, but no drinks.
In the case of full board or half board, drinks are not included, unless specifically mentioned in the description.  In some countries drinking water is not always available, and any bottles of drinking water bought are therefore at the customer’s expense.  It is necessary to comply with the all relevant rules, particularly with regard to the opening hours of the restaurant(s) or bar(s), and the places designated for the consumption of meals and drinks.

e. Activities offered during your stay
An activity may not be appropriate for all ages or for individuals with certain medical conditions. TropiQ Trips may not be held liable in the event of an incident or accident which is due to a lack of vigilance on your part.
It may happen that certain activities referred to in the Trip description are no longer provided by our local provider for climatic reasons, in the event of force majeure, during a stay out of the tourist season, or when the minimum number of participants required for providing a given activity is not reached (examples:  group sports, children’s clubs). In the early or late season some activities may not be available, some of the facilities (restaurant, swimming pool, etc.) may be closed, or maintenance work may be in progress.  As a general rule, entertainment and sports activities may vary in frequency depending on how many people are staying at the time and on climatic conditions.  Particularly during the high season, it is possible that the number of parasols, loungers, sports equipment, etc., are insufficient for the demand.  The opening hours of bars, restaurants, and clubs, etc., may be irregular and dependent on the management of the establishment in question.  You agree that TropiQ Trips is not liable for activities unavailable due to any of the reasons listed above.
The sports activities offered for collective participation are often organized by outside providers.  Any travel costs related to such activities are at the customer’s expense.  Similarly, these activities may be withdrawn at the discretion of the organizer if there is insufficient demand.  This will not give rise to any entitlement to compensation.

You acknowledge that the use or enjoyment of an activity may be hazardous and inherently risky, and, to the maximum extent permitted by law, TropiQ Trips shall have no liability for any personal injury or death; lost, stolen, damaged or destroyed property; or other liability arising out of or in connection with the use and operation of the activity, and all actions or events occurring prior to, during, at or after, the activity.

f. Infants
We ask parents travelling with infants to bring with them the appropriate food for their child, as they may not be able to find it at their destination.  You may be asked to pay a charge, for example for provision of a cot and/or for heating baby food and drinks. You should request this when making your reservation, though we cannot confirm the availability of such services.

g. Pregnant women
TropiQ Trips advises pregnant women to consult their doctors before making any reservation, in order to confirm that it is appropriate for them to participate in the Trip.   You agree that TropiQ Trips will not be liable for any damages arising from inability to participate in any or all of the Trip due to pregnancy or related illness and no compensation will be payable under such circumstances.

h. Travelers with special needs or disabilities
If you have special needs or a disability you must call the provider of your accommodations ahead of time and verify that special needs can be met. TropiQ Trips makes no guarantee as to the ability of any accommodations, activity provider, or facilities advertised on its site to meet the special needs of disabled clients.  TropiQ Trips has no special knowledge regarding the suitability for disabled persons of any portion of any tour or activity offered. For information concerning the suitability for disabled persons for any portion of any tour or other reservation, contact the supplier directly.

Payments
Payment of the Balance may be made by personal or cashier’s check, money order, or credit card (Visa / MasterCard / American Express). You may only make payment less than 60 days before the Tour Start Date after you have our written agreement to accept your late payment. If you do not have TropiQ Trips prior written approval for late payment, and you have not paid the Balance when due, TropiQ Trips reserves the right to treat your Reservation as cancelled and subject to the CANCELLATION BY CUSTOMER provisions in these Terms.

No one will be allowed to depart on a trip unless all payments and necessary documents have been received by TropiQ Trips. All published prices and rates are based on double occupancy and are subject to a 3% credit card fee. Please contact us directly for the Trip Cost if payment of the Balance will be by credit card.

Cancellation by Customer
Except cancellations by you that occur as a result of other reasons stated in these Terms, a cancellation by you must be in writing and must actually be received by TropiQ Trips. Other situations can result in a cancellation by you. These situations are stated throughout these Terms.

All cancellations by the Customer are subject to a cancellation fee. Cancellation fees are per person and calculated based on the Tour Start Date.

In addition to the fee stated above, the following will be added to and part of the cancellation fee per person: any cancellation fees, surcharges, or non-refundable deposits charged to TropiQ Trips by its vendors and suppliers, such as individual hotels, airlines or other third parties.

Some Galapagos, Antarctica and Amazon vessels apply a different cancellation schedule. In this case, the vessel’s cancellation policy is in addition to TropiQ Trips’ cancellation policy.

Cancellation fees will be withheld from existing deposits or other payments by you to TropiQ Trips. If the cancellation fees total more than the existing deposits or other payments, then you must pay the outstanding balance within 30 days. If the cancellation fees total less than the existing deposits or other payments, then the remaining balance will be refunded to you.

No partial refunds will be given for unused hotel rooms, meals, sightseeing trips, trekking arrangements, or other segments or portions of your trip for any reason whatsoever. The Trip Cost is quoted as a package and refunds and credits are not given for services not used.

Cancellation by TropiQ Trips or its Suppliers

TropiQ Trips reserves the right to cancel any Reservation or trip if: (i) the 2 (two) person minimum is not met, and/or (ii) the number of Customers signed up makes the trip economically unfeasible to operate. If these events happen, a full refund of the Trip Cost is given. However, TropiQ Trips is not responsible for additional expenses incurred by travellers preparing for the trip (i.e., non-refundable “Advance Purchase” air tickets, equipment, medical expenses, etc.).

TropiQ Trips also reserves the right to cancel any trip: (iii) in the case of a Force Majeure event, and/or (iv) if a third-party supplier’s cancellation occurs outside the control of TropiQ Trips. NO REFUND IS GUARANTEED if a tour is cancelled due to these events. TropiQ Trips has the SOLE DISCRETION AND RIGHT TO MAKE A DECISION about refunds based on the circumstances that give rise to these events and the timing, INCLUDING NO REFUND WHATSOEVER. TropiQ Trips also reserves the right to offer, at its sole discretion, an alternative tour if the reserved trip is cancelled for these reasons ((iii) and (iv)).

BECAUSE CANCELLATION AND/OR CHANGES MAY OCCUR WITHOUT REFUND AND/OR RESULT IN COSTS FOR WHICH YOU DO NOT HAVE RECOURSE AGAINST TROPIQ TRIPS AND/OR ITS SUPPLIERS, IT IS HIGHLY RECOMMENDED THAT YOU OBTAIN TRAVEL INSURANCE THAT COVERS ALL YOUR COSTS AND POTENTIAL COSTS.

Changes to a trip may occur. Refer to the section in these Terms on Changes by TropiQ Trips for some changes that may occur.

Except as otherwise provided in these Terms, if transportation or other services are cancelled by us, all sums paid to us for services not performed in accordance with these Terms will be refunded within thirty days of receiving the funds from the supplier with whom the services were arranged, or if the funds were not sent to the supplier, the funds shall be returned within fourteen days after cancellation by us to you unless you request that we apply the money to another travel product and/or date.

Prices, Surcharges and Validity

TropiQ Trips publishes trip prices in advance and, rarely but, occasionally faces significant cost increases due to factors over which we have no control. Consequently, in order to offer our services in an economically feasible manner at valuable prices to you, we reserve the right to pass along to you surcharges due to unfavourable exchange rates, increases in airfares or other transport costs, taxes, or if government action should require us to do so. Surcharges will be calculated according to the full extra cost, compared to the original costs and exchange rates.

Airlines

TropiQ Trips is not responsible for any acts or failures to act of any airlines. We may use airlines different than the one(s) mentioned in our advertisements, and TropiQ Trips is not able to guarantee the type of aircraft to be used by any airline. It is common on tours arranged by TropiQ Trips that flights with small airlines and/or on small aircraft are part of the itinerary. By making a Reservation with us, you acknowledge and accept this possibility.

In addition, TropiQ Trips is not responsible for losses due to cancelled flights, or changed flight itineraries or seat assignment. The responsibility of the airlines is limited to the carriage of passengers and baggage in accordance with the airline’s terms and conditions of service.

If you cancel a Reservation due to a change of airline, aircraft type, route, or destination, additional penalties and fees, in addition to the cancellation fees stated above, are likely to be applied by the airline. We have no control over the airline’s cancellation or penalty fees. In addition, your cancellation or refusal to agree to flight arrangements or changes after the itinerary is final may cause a cancellation of your Reservation. In that case, the CANCELLATION BY CUSTOMER provisions and fees stated in these Terms apply.

Delays

Any costs, whether direct or incidental, incurred by you as the result of delays caused by bad weather, trail conditions, river levels, road conditions, transportation delays, sickness, government intervention or other contingencies which are beyond the control of TropiQ Trips will not be reimbursed.

Changes by TropiQ Trips or its Suppliers

Reasonable changes in the itinerary may be made for your comfort and well-being where deemed advisable by TropiQ Trips or its suppliers because of unforeseen circumstances or because of circumstances beyond the control of TropiQ Trips. Consider your itinerary as a guide; it is not a contract.

If any such change is made prior to the time the initial deposit is paid, we will tell you of the change at the time of booking. If a change is made thereafter, TropiQ Trips will inform you as soon as is reasonably possible. If you cancel your Reservation as a result of any such change the CANCELLATION BY CUSTOMER provision above will apply. TROPIQ TRIPS SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM OR RELATED TO ANY SUCH CHANGE AND THE CUSTOMER WAIVES THE RIGHT TO ASSERT A CLAIM FOR SUCH DAMAGES AGAINST TROPIQ TRIPS.

Changes by the Customer

You are responsible for the actual cost of all changes to a Reservation that are made by you. TropiQ Trips is not responsible for additional expenses incurred by you as a result of such changes, including but not limited to non-refundable “Advance Purchase” air tickets, etc.

In addition, you must pay TropiQ Trips an administrative fee per change that you make before the Tour Start Date according to the following schedule:
Between 90 and 30 days prior will be charged $30
Between 29 and 15 days prior will be charged $50
We cannot accept changes by you within 14 days of the Tour Start Date. This includes, without limitation, booking additional accommodations, transfers, or excursions.

This section applies only to changes. Cancellations are subject to other provisions in these Terms.

Authority on Tour

As part of the learning and enjoyment of your tour, you are likely to experience different cultural and social norms. You will also be subject to the laws of the country or countries you travel in. For the legal compliance and safety of TropiQ Trips and its suppliers, as well as the safety, well-being, and enjoyment of other Customers, you must comply at all times with the law and respect the norms of the locations you visit. This includes laws that apply to customs, foreign exchange, immigration, and drug control.

From time to time external circumstances, or a Customer’s fitness, health, behaviour or other activity or decision(s) may threaten the safety, or interfere with the well-being, of the group or individual Customers. As a result, at all times the decision of TropiQ Trips, its suppliers, the tour leader, and/or any representative of TropiQ Trips or the suppliers is final on all such matters.

If you fail to comply with this section, or if you should interfere with the well-being of the group or individual Customers, then TropiQ Trips, its suppliers, the tour leader, and/or any representative of TropiQ Trips or the suppliers may order you to leave the tour without recourse to any refund or for damages. If this happens and any person traveling with you must also leave or chooses to leave the tour with you, they will likewise have no recourse to any refund or for damages

Tour Start Date

It is your responsibility to be ready to embark on the tour as specified in the itinerary. TropiQ Trips is not responsible for any losses due to cancelled or missed flights, changed flight itineraries, late arrivals, or early departures.

Medical Fitness & Health

It is vital that Customers with TropiQ Trips, its suppliers, the tour leader, and/or any representative of TropiQ Trips or the suppliers (collectively “trip leader”) has the right to disqualify anyone at any time during the trip if the trip leader believes that the Customer’s continued participation will jeopardize the health or well-being of the Customer involved or the group. No refunds of any type are given to the Customer, or to any person traveling with the Customer, when a medical or health condition or limitation of a Customer is not disclosed at the time of booking and results in the Customer being unable to participate in any portion of the trip or causes the Customer to leave the trip for any reason (including being asked to leave by a trip leader). A Customer has failed to disclose a medical or health condition or limitation if the condition or limitation is disclosed but not the scope.

In the event you are injured or become ill and you timely notify us, TropiQ Trips will work with you or otherwise attempt to secure medical attention. However, TropiQ Trips assumes no responsibility for or regarding the provision of medical care or its cost.

TropiQ Trips expressly disclaims any and all liability for medical care or for special dietary requirements. TropiQ Trips does NOT warrant or make any representations that the company or any representative, or any third-party supplier or tour leader can or will make a determination that an individual Customer IS adequately healthy or fit to embark, continue, or participate in a tour, and TropiQ Trips expressly disclaims any such warranties or representations. The responsibility for any determination in favour of embarking, continuing, or participating in a portion of a tour remains solely with you.

Baggage

TropiQ Trips assumes no liability for loss or damage to baggage in transit to and from a TropiQ Trips trip or while on a TropiQ Trips trip.

Travel Insurance

Because of the rights stated in these Terms, and because of other potential known and unknown external circumstances that may occur (which is an inherent risk of any travel), TropiQ Trips HIGHLY RECOMMENDS THAT YOU OBTAIN PERSONAL TRAVEL INSURANCE, including baggage and cancellation insurance. Travel Insurance is a cost-effective way to protect yourself and your equipment in the event of problems due to – Cancelled Trips, Delays, some Medical Problems, Baggage Loss or Damage. Travel insurance may be purchased through traditional insurers or online insurers. TropiQ Trips will be happy to offer you travel insurance through Travel Guard but you are in no way obliged to purchase travel insurance through TropiQ Trips.

By declining travel protection, you acknowledge and accept liability for any cancellation penalties, damages and/or out–of-pocket expenses incurred.  You also acknowledge and accept responsibility for arranging and paying for any treatment in case of a medical emergency while traveling. Please note that if you decline this type of coverage, you have waived your right to this important coverage and your confirmation will note “declined” next to the travel protection section of your confirmation. If you HAVE purchased travel protection, please remember to review your confirmation for accuracy and call us immediately if you believe you have travel protection and your confirmation indicates declined. Failure to contact us will be considered a waiver of travel protection.

We urge you to read your policy when it arrives as it contains important information. This information includes, but is not limited to, details on the extent of coverage and procedures for making a claim.

All requests for service under the policy must be filed directly with the travel insurance provider, in accordance with the policy terms and conditions, which you the passenger are responsible for reviewing upon receipt of your travel protection policy. TropiQ Trips is not able to give advice with regard to possible cancellations and any associated claims processing. All queries regarding cancellation, penalties, coverage should be directed to your particular travel insurance provider.  Please note that the travel insurance provider may not be allowed to discuss your claim with TropiQ Trips due to privacy laws (e.g. HIPAA). Accordingly, you acknowledge that TropiQ Trips cannot be involved in any aspect of your claim/request for service. Passenger(s) acknowledge and agree that TropiQ Trips has no control over the travel insurance provider or its coverage decisions, and as a result TropiQ Trips is not responsible for and shall not be liable for policy coverage, claims processing, or the denial of any claims.

Medical Insurance

IT IS HIGHLY RECOMMENDED THAT YOU HAVE MEDICAL INSURANCE FOR YOUR TRIP. WE RECOMMEND THAT YOU COMMUNICATE WITH YOUR INSURER AND CONFIRM THAT YOU WILL HAVE COVERAGE ON YOUR TRIP AND HOW MUCH, OR THAT YOU PURCHASE (ADDITIONAL) MEDICAL INSURANCE. Illness, accidents, and even the possibility of death are risks at any time. When you are traveling abroad these events can result in a range of unexpected expenses to you, from minor to burdensome, and there is no way of knowing ahead of time what the amount of expense may be. It may be that you fall ill and need to pay several hundred dollars for medical care or you may experience a grave accident that requires medical care, rescue including air lifts, loss of limbs or even repatriation costs in the hundreds of thousands of dollars. TropiQ Trips is not responsible for these costs. You must weigh the risks and decide how much medical insurance coverage you and those you are responsible for will need and make certain that you have obtained both the limits you want and the coverage you may need. Because every traveller weighs these risks differently, TROPIQ TRIPS cannot advise you on what limits of coverage you should buy. TROPIQ TRIPS EXPRESSLY DISCLAIMS LIABILITY FOR ANY REPRESENTATION OR WARRANTY TROPIQ TRIPS SHARES WITH YOU ABOUT MEDICAL INSURANCE COVERAGE AND LIMITS. YOU ARE SOLELY RESPONSIBLE FOR YOUR DECISIONS REGARDING MEDICAL INSURANCE COVERAGE AND LIMITS.

Documents

You must have and it is solely your responsibility to obtain and carry with you a valid passport, all visas, permits and certificates, vaccination certificates, and any other documentation required for the entire tour. Pursuant to governing travel regulations and requirements, ALL PASSPORTS OF TRAVELERS MUST BE VALID AT LEAST 185 DAYS FROM THE DATE OF DEPARTURE.

We are pleased to provide you with information about visas, vaccinations, climate, clothing, baggage, special equipment, etc. However, that information is given to you by us without responsibility on the part for accuracy and lawfulness. By making a Reservation, you expressly waives any claim that TropiQ Trips is liable for damages arising from such information.

Claims and Complaints

Many problems that might arise during a trip can be rectified quickly and in a manner that allows you to continue to enjoy your trip if you bring them to the attention of the supplier, trip leader, or person “on-the-ground” at the time they arise and during your trip. Therefore, if you find that you have a complaint or claim against TropiQ Trips, you must first attempt to obtain a correction of the problem during the trip. If the problem is not solved this way, then you must inform TropiQ Trips of the claim or complaint in writing within five days after the end of the trip. If you fail to comply with these requirements, you waive your right to assert any such claim or complaint against TropiQ Trips.

Release of Liability and Assumption of Risk

By signing these Terms and making a Reservation, you acknowledge that the cost of all TropiQ Trips trips have been based upon Customers agreeing to (A) these Terms, (B) the Arbitration and Limitation of Remedies provisions, and (C) the Release of Liability, Assumption of All Risks, and Indemnification Agreement. Therefore, as lawful consideration for being permitted to participate on such adventure travel activities you acknowledge that you understand and agree to these Terms including the requirement to agree to the Release of Liability, Assumption of All Risks, and Indemnification Agreement and acknowledgement of the Arbitration and Limitation of Remedies provisions.

Severability

In the event that one or more of the provisions of the Terms or the Arbitration and Limitation of Remedies provisions, for any reason, is held to be invalid or unenforceable in any respect, such invalidity or unenforceability shall not affect any other provision hereof, and the Terms and provisions shall be construed as if such invalid or unenforceable provision had never been contained herein.

Entire Agreement

The Trip Application, which includes these Booking Terms and Conditions, the Arbitration and Limitation of Remedies provisions, and the Release of Liability, Assumption of All Risks, and Indemnification Agreement, contains the entire understanding between you and TropiQ Trips in connection with the subject matter of the Trip Application and it supersedes and replaces all prior negotiations, statements, and representations concerning the subject matter of the Trip Application.

Amendment

These Terms may not be amended, altered or modified, except by a written amendment executed by an authorized representative of TropiQ Trips.

Construction

It is the intent of the Customer and TropiQ Trips that no part of the Terms be construed against any party because of the identity of the drafter.

Attorney Fees and Costs

If the meaning or application of the Terms is at issue in any dispute between you (or your heirs or assigns) and TropiQ Trips, the substantially prevailing party shall be entitled to recover its, his or her expenses, attorney fees and costs.

Successors and Assigns

This agreement shall inure to the benefit of and be binding upon TropiQ Trips and you and your respective heirs, legal personal representatives, successors and assigns.

Updating of Terms and Conditions

TropiQ Trips reserves the right to update and/or alter these terms and conditions at any time. It is your responsibility to be familiar with these terms and conditions. The latest terms and conditions can be found on the TropiQ Trips website: TropiQTrips.com.
I have read this entire agreement, and I am agreeing to it freely. I understand that this is a legally binding contract. No other representations concerning the legal effect of this document have been made to me. My agreement applies to all sections of the Booking Terms and Conditions Agreement.
